Provisional Patent Application

A provisional patent application never becomes a patent itself. It requies the filing of a non-provisional patent application within one year, or conversion to a non-provisional patent application within a year.


Provisional patents are interim patent applications; they provide patent pending status without having to file a regular patent application with claims and such. An inventor may file for a provisional patent application and if it sufficiently describes the invention, his or her idea will be protected for one year.
