What is a continuation-in-part patent application?

A continuation-in-part patent application is a newly-filed patent application that adds matter to a previously-filed parent application.


Continuation-in-part Patent Applications

The continuation-in-part application is officially linked to its parent application and therefore can claim priority rights based on the parent application’s filing date, but only as to the common material. A continuation-in-part application mostly reuses a large portion of the specifications originally written for the parent application; however, it can further enhance those specifications to include modifications of the invention developed after the parent application was already filed. At least one common inventor must be named for both the continuation-in-part application and the parent application.
