What is a continuation patent application?

A continuation patent application is a newly-filed patent application that adds claims to an already-filed patent application, known commonly as the parent application.


Continuation Patent Applications

The continuation patent application is linked to its parent application through shared specifications and, as such, can claim priority rights based on the parent application’s filing date. The continuation patent application differs from the parent application in that additional claims may be submitted, mostly to re-adjust previous claims that have already been rejected by an examiner, or to just further add more claims to the original set, thereby making the patent application more comprehensive in its protection. At least one common inventor must be named for both the continuation application and the parent application.
