What is a divisional patent application?

A divisional patent application is a newly filed patent application that is linked with a previously filed application, which is named the parent application, whereby the new application references matters in the parent application.

Divisional Patent Applications

When a parent application becomes too bloated with invention disclosures, meaning the application claims more than one invention, the inventor is required to divide the parent application into individual divisional patent applications, each based on one specific invention disclosure. Since divisional patent applications are officially connected to the parent application from which they were created, they all retain priority rights based on the parent application’s filing date rather than their own individual filing dates.
