What is a “Common Law Patent”?

There is no such thing as a common law patent.

Patent rights exist only under federal laws; there are no state laws that cover patents and no common laws that cover patents. Of course, state and common laws can apply to property rights in patents and patent applications, but they provide no patent protection.
