The U.S. Supreme Court left open the continued patentability of business methods in their recent (June 28, 2010) decision in the case of In re Bilski.
While the Supreme Court agreed with the ruling of the Federal Circuit that Bilski’s invention was not patentable, they disagreed with the Federal Circuit Court that a machine or transformation test was the rule for deciding patentability of business methods, and also found that the machine or transformation tests were useful in assessing patentability but that they are not determinative.
