What is false marking?

“False Marking” is marking an invention with patent numbers when there is no patent on the invention. This typically occurs when a patent expires, since such a condition means there is no longer that numbered patent covering the invention.


False Marking claims are brought as Qui Tam actions because the person bringing the action is not damaged, so there is an inference that the government (which issues the patent) is damaged. In a Qui Tam action, the claimant sues on behalf of the government and splits the proceeds of any damage awards.
