What is Patent Law?

Patent law varies across the globe. In the U.S., patent law is governed by the United States Patent and Trademark Office (USPTO). The USPTO oversees the patent laws and rules and is responsible for examining patent applications. The USPTO also stores all the information on patent files and supply copies of patent files to the public.


What is a patent?

As stated by the USPTO, a patent will grant the patent holder the "right to exclude others from making, using, offering for sale, or selling the invention in the United States or importing the invention into the United States ". The important point to note from this statement is that the patent gives the owner the right to exclude others from making, using, offering for sale, selling or importing their invention.

What are the types of patents?

In the U.S. , there are three types of patents. These consist of utility patents, design patents, and plant patents. Utility patents are the most common of the three and cover the invention of any new and useful process, composition of matter, machine, or article of manufacture.
