Why do items say “Patented”?

Once an invention has been patented, the inventor should mark advertising and the invention with the word “Patented”.


In fact, the inventor should mark the invention with the actual patent number issued. If the inventor does not so mark the invention, the inventor gives up the ability to recover enhanced damages, which can be up to treble the actual damages. However, once a patent expires, the word Patented and/or the patent numbers should be removed from the invention to prevent claims of “False Marking”.
